2.2 Submission of an Application does not guarantee acceptance.
2.3 The Organiser may accept or decline an Application having regard to available space, proposed products or services, Trader mix, operational requirements and the overall requirements of the Event.
2.4 The Contract comes into existence when the Organiser issues an Acceptance Confirmation, which may be given by email, including the email sending the Organiser’s invoice.
2.5 Following acceptance, the Organiser will issue an invoice setting out the Charges payable.
2.6 Unless otherwise expressly stated on the invoice, Charges must be paid in full within seven days of the invoice date.
2.7 Failure to pay within the required period may result in the Pitch being released and the Contract terminated.
2.8 As part of the online Application, the Trader is required to confirm that they have read, understood and agreed to be bound by these Terms & Conditions.
2.9 Applications for the Event must be submitted by the Application Deadline. The Organiser may, at its discretion, consider Applications received after that date, subject to availability.
3.1 The Contract constitutes the entire agreement between the Organiser and Trader concerning participation in the Event.
3.2 The Trader is responsible for making its own commercial assessment of whether participation is appropriate for its business.
3.3 Unless expressly incorporated into the Contract in writing, information supplied concerning anticipated attendance, footfall, ticket sales, Trader numbers, product or cuisine mix, Pitch position, customer expenditure or anticipated trading performance is provided for general information and planning purposes only.
3.4 No statement, estimate, projection or forecast constitutes a guarantee of commercial performance unless expressly stated by the Organiser in writing to be a contractual guarantee.
3.5 Nothing in this clause excludes liability for fraud, fraudulent misrepresentation or any liability which cannot lawfully be excluded.
3.6 The Trader confirms that, in entering into the Contract, it has not relied on any statement, estimate, projection or forecast made by or on behalf of the Organiser which is not set out in the Contract, including any statement about attendance, footfall, ticket sales, Trader numbers, product or cuisine mix or Pitch position.
4.1 The Trader acknowledges that attendance and customer behaviour at an outdoor live Event may be affected by weather, advance ticket sales, transport, competing events, economic conditions and other circumstances.
4.2 Previous attendance figures and anticipated attendance figures are provided for background and planning purposes only.
4.3 Unless expressly guaranteed in writing as part of the Contract, the Organiser does not guarantee: (a) any minimum attendance; (b) any minimum footfall; (c) any particular customer demographic; (d) any minimum level of customer expenditure; (e) any level of sales, turnover, revenue or profit; or (f) that previous Event attendance or Trader performance will be repeated.
4.4 Participation represents a commercial opportunity and not a guarantee of financial return.
4.5 The Trader remains responsible for determining appropriate staffing, stock levels, pricing and other commercial decisions.
5.1 The Organiser aims to curate a varied and commercially appropriate mix of food, retail and other Traders.
5.2 Any information concerning anticipated Trader numbers, numbers within a particular category, cuisine mix or product mix represents the Organiser’s current planning position only.
5.3 The final number and mix may change because of subsequent applications, withdrawals, cancellations, site planning, licensing or operational requirements.
5.4 Unless expressly agreed otherwise in writing, the Organiser does not guarantee: (a) a maximum or minimum number of Traders; (b) a maximum or minimum number within a particular category; (c) a particular cuisine or product mix; or (d) the absence of another Trader selling similar or competing products.
5.5 No Trader is granted exclusivity over a product, cuisine, service or trading category unless expressly agreed in writing as part of the Contract.
5.6 The Organiser will nevertheless use reasonable endeavours to maintain an appropriate and diverse mix of Traders.
The Trader may only sell, supply or distribute products or services disclosed in the Application and approved by the Organiser. The Trader must not materially alter its menu, product range or trading activity without prior written approval.
Catering Traders must offer at least one value meal priced at £5.00, together with any other menu requirements stated on the Application for the Event.
All beverage sales at Bournemouth Reggae Weekender are reserved exclusively to the Organiser and/or beverage concessions expressly authorised by the Organiser.
Unless expressly authorised in writing, Traders must not sell, supply, distribute, give away or include within any meal, meal deal, promotion or other transaction any beverage.
This restriction includes, without limitation:
Where the Organiser has appointed an exclusive hot-drinks concession, Traders must not sell, supply or distribute tea, coffee, hot chocolate or other hot beverages unless expressly authorised.
Food Traders may offer food-only meal deals but must not include a beverage within the advertised or charged price unless expressly authorised.
Traders must not circumvent beverage exclusivity by describing drinks as complimentary, free, included with a meal or otherwise supplied without a separately stated charge.
Water supplied or made available for food preparation, handwashing, cleaning or other operational purposes must not be sold or supplied to customers as a commercial product.
Nothing in this clause prevents the Organiser from making water available for public safety, welfare, staff welfare, licensing requirements or compliance with applicable law.
Where a Trader is found selling or supplying unauthorised beverages or other unauthorised products, the Organiser may require the activity to cease immediately. A continued, repeated or material breach may result in suspension or termination of the Trader’s right to trade and removal of the unauthorised products. Where termination results from such material or repeated breach, Charges will not normally be refundable, subject to applicable law.
7.1 All Pitch positions are allocated by the Organiser.
7.2 Traders must provide accurate dimensions for their complete trading unit, including tow bars, drawbars, doors, awnings, guy ropes, storage and other projections.
7.3 Any Pitch number, zone, site plan or proposed position supplied before the Event is based upon the Organiser’s site plan at that time.
7.4 Pitch positions may reasonably be changed before or during the Event where necessary because of health and safety, licensing, emergency access, crowd management, electricity or utilities, production infrastructure, ground conditions, weather, accessibility, inaccurate Trader dimensions, security requirements or other reasonable operational requirements.
7.5 Where relocation is reasonably necessary, the Organiser will use reasonable endeavours to provide a suitable alternative Pitch.
7.6 The Organiser does not guarantee any particular level of footfall, visibility, passing traffic or proximity to an entrance, stage, bar, attraction or another Trader.
7.7 Traders may not move, exchange, transfer, share or sublet a Pitch without prior written approval.
8.1 Electricity is a separately chargeable service unless expressly stated otherwise on the invoice.
8.2 Traders requiring electricity must request it in advance and submit the required Electricity Supply Request identifying all equipment and maximum electrical load.
8.3 Traders must not connect undeclared equipment or exceed the approved electrical capacity.
8.4 The Event uses temporary electrical infrastructure which must be installed, inspected, tested and commissioned as part of the Event build.
8.5 The Organiser will use reasonable endeavours to make an approved electricity supply available in sufficient time for the Trader to prepare for the commencement of trading.
8.6 Electricity is not guaranteed to be available immediately upon the Trader’s arrival or at a specific time during set-up unless a specific connection time has expressly been confirmed in writing.
8.7 Connection may be affected by installation progress, testing, weather, site conditions, safety requirements or circumstances outside the Organiser’s reasonable control.
8.8 Where electricity has been purchased, the Organiser will use reasonable endeavours to provide the approved capacity during Designated Trading Hours, subject to temporary interruptions, emergencies, safety requirements and circumstances outside its reasonable control.

9.4 The Organiser may prevent the use of equipment or activities reasonably considered unsafe or non-compliant.
9.5 A serious or continuing safety breach may result in suspension or termination of the right to trade.
10.1 Unless expressly agreed otherwise, Traders are responsible for providing their own trading unit, stock, equipment, tables, furniture, lighting, cooking equipment, storage, staffing and other items necessary to operate.
10.2 Traders must comply with the Organiser’s environmental and packaging requirements. All food and other items must be served in eco-friendly, compostable packaging made from wood, paper or leaf-based materials.

11.2 Traders must arrive within their allocated access period unless otherwise authorised.
11.3 Traders are responsible for arriving with sufficient time, equipment and personnel to complete their own set-up before trading.
11.4 For safety reasons, no vehicle movement is permitted on site during Designated Trading Hours, except under the direct supervision of the Event Safety Team where it is safe to do so.
11.5 Vehicle passes must be displayed where required.
11.6 Each Trader is permitted one vehicle on site. Additional vehicles must be parked off site or in any area the Organiser designates for that purpose.
11.7 The Organiser may reasonably amend access and vehicle arrangements because of health and safety, weather, ground conditions, crowd management or operational requirements.
12.1 Traders commit to trade throughout the Festival Period during Designated Trading Hours unless otherwise authorised.
12.2 Traders must not close or leave the Event early without permission from the Traders’ Manager except where reasonably necessary because of an emergency or immediate safety issue.
12.3 Where a Trader believes that an operational, safety, Pitch, electricity or infrastructure issue materially affects its ability to trade, the Trader must report the matter promptly to the Traders’ Manager so that the Organiser has a reasonable opportunity to investigate and, where appropriate, remedy the issue.
12.4 Reporting an issue does not prevent a Trader from exercising any legal rights or remedies available to it.
13.1 Traders must keep their Pitch clean, safe and reasonably free of rubbish.
13.2 Traders must use the waste facilities and procedures specified by the Organiser.
13.3 Catering Traders must purchase/use applicable waste provision where required by the Application.
13.4 Waste, cooking oil, wastewater, charcoal or other materials must not be deposited on the ground, into drains or in unauthorised locations.
13.5 Where a Trader leaves its Pitch or the surrounding area uncleared, or the Organiser incurs additional cleaning, waste-removal or remediation costs because of a Trader’s breach, the Organiser may charge the Trader a site-clearance charge of up to £200, reflecting the Organiser’s reasonable cost of clearance.
14.1 Traders and their staff must behave professionally towards attendees, Event staff, contractors, security personnel, regulatory officers and other Traders.
14.2 Threatening, abusive, discriminatory, violent or seriously disruptive behaviour will not be tolerated.
14.3 Serious misconduct may result in immediate removal.
14.4 Music from a Pitch must remain at a level approved by the Organiser and must not interfere with programmed entertainment.
14.5 Live entertainment from a Pitch is prohibited unless expressly authorised.
15.1 Any general security provided by the Organiser supports overall Event-site security and does not constitute custody or insurance of Trader property.
15.2 Traders remain responsible for cash, stock, equipment, vehicles and personal property.
15.3 Traders are responsible for maintaining appropriate insurance for their property and activities.
16.1 Trader camping is permitted only where expressly approved and in locations designated by the Organiser.
16.2 Traders camping on site remain responsible for their belongings and personal arrangements, subject to any liability which cannot lawfully be excluded.
16.3 Unauthorised vehicles, fires, generators or other prohibited equipment must not be used within camping areas.
17.1 Charges shall be those stated in the Application and invoice.
17.2 Where applicable, the invoice may separately identify the Pitch Fee, Additional Space, Electricity, Waste Facilities and other agreed services.
17.3 Charges must be paid in full within seven days of invoice, unless expressly agreed otherwise in writing.
17.4 Failure to pay within the specified period may result in the Pitch being released.
17.5 Amounts due must be paid without deduction or set-off except where required by law.
18.1 For the Event, the Withdrawal Deadline is 10 March 2027. This date is also stated on the Trader Application page.
18.2 Where written notice of withdrawal is received on or before the Withdrawal Deadline, the Trader will receive a 50% refund of the Pitch Fee and any electricity charge paid (rental and power fees), unless a different arrangement is expressly stated in the Contract.
18.3 No refunds will be given for withdrawals received after 10 March 2027.
18.4 Withdrawal must be made in writing to the BRW Trading Team.
19.1 The Organiser may cancel, postpone, curtail or materially alter the Event where reasonably necessary because of circumstances outside its reasonable control. These may include severe weather, flood, fire, epidemic, government or local-authority action, national emergency, terrorism or credible threat thereof, public-safety concerns, failure of essential infrastructure or other force-majeure circumstances.
19.2 Traders will be informed as soon as reasonably practicable.
19.3 Where electricity has been separately purchased but the service is not provided because the Event is cancelled before commencement, the electricity charge will be refunded.
19.4 Pitch Fees and all other Charges, other than electricity charges refunded under clause 19.3, will not be refundable where cancellation results from circumstances outside the Organiser’s reasonable control, subject to applicable law.
19.5 Where a replacement Event or rollover is offered, participation will be subject to availability and the terms communicated by the Organiser.
20.1 The Organiser may suspend or terminate the Trader’s right to trade where the Trader materially breaches the Contract.
20.2 Where reasonably practicable, the Organiser will first notify the Trader of the breach and provide a reasonable opportunity to remedy it.
20.3 Immediate suspension or termination may occur where reasonably necessary because of serious health or safety risks; illegal activity; violence, threats or serious abusive conduct; unauthorised alcohol or beverage sales; material or repeated breach of product restrictions; deliberate interference with electrical or safety infrastructure; unauthorised subletting; failure to maintain required insurance/licences; or another material breach incapable of reasonable remedy.
20.4 Where termination results from the Trader’s material breach, Charges will not normally be refundable, subject to applicable law.
21.1 Termination does not affect accrued rights, obligations or liabilities existing at the termination date.
21.2 Any provision intended expressly or by implication to survive termination shall continue to apply.
22.1 Subject to applicable law, the Trader shall indemnify the Organiser against reasonable losses, liabilities, claims, damages, costs and expenses incurred to the extent directly arising from: (a) the Trader’s material breach of the Contract; (b) negligent acts or omissions of the Trader or its personnel; (c) unlawful activities of the Trader; or (d) injury or property damage caused by the Trader’s products, equipment or operations, except to the extent that the relevant loss was caused or contributed to by the Organiser’s own negligence or breach.
23.1 Nothing in the Contract limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot lawfully be limited or excluded.
23.2 Subject to clause 23.1, the Organiser shall not be liable for loss of profit, loss of anticipated revenue or indirect or consequential loss arising from participation in the Event.
23.3 Subject to clause 23.1, the Organiser’s total aggregate liability arising under or in connection with the Contract shall not exceed the total Charges paid by the Trader under the Contract.
23.4 Nothing in this clause affects rights or remedies which cannot lawfully be excluded or restricted.
24.1 The Organiser will provide operational information through the Trader Pack, Pitch Allocation communication and/or subsequent written instructions.
24.2 This may include Pitch allocation, site plan, arrival/access instructions, Set-Up Hours, vehicle arrangements, trading hours, electricity arrangements, waste procedures, emergency procedures and Event contact information.
24.3 Operational arrangements may reasonably be amended where necessary for safety, licensing, infrastructure or effective Event management.
24.4 Where the Trader Pack conflicts with these Terms & Conditions on a contractual matter, these Terms & Conditions prevail unless a subsequent contractual variation has expressly been agreed in writing.
25.1 No material variation to the Contract shall be binding unless agreed in writing by or on behalf of both parties.
25.2 The Organiser may make reasonable operational changes which do not materially alter the nature of the Trader’s participation where required for safety, legal, licensing or Event-management purposes.
25.3 The version of these Terms & Conditions accepted when the Trader submits its Application shall apply to that Contract unless subsequently varied in accordance with this clause.
25.4 These Terms & Conditions apply to Bournemouth Reggae Weekender 2027 only. Contracts for earlier Events remain governed by the Terms & Conditions in force for that Event.
26.1 The Trader’s rights are personal to the business accepted by the Organiser.
26.2 Traders may not transfer, assign, share or sublet their Pitch without prior written consent.
26.3 Any business trading without completing the Organiser’s approval process may be removed.

A person who is not a party to the Contract shall have no right to enforce its provisions except where expressly provided by law.
If any provision or part-provision is found invalid, unlawful or unenforceable, it shall, so far as legally possible, be modified or deleted to the minimum extent necessary without affecting the remaining provisions.
Failure or delay by either party in exercising a contractual right or remedy does not constitute a waiver of that right or remedy.
31.1 Formal notices concerning withdrawal, termination or material contractual matters must be made in writing.
31.2 Notices to the Organiser should be sent to Afro*disiac Live Radio CIC, 932 Christchurch Road, Bournemouth, BH7 6DL, or by email to events@afro-disiac.co.uk.
